What the source establishes

The en banc holding is that the 2023 amendment applies retroactively under Landgraf, and that plaintiffs are entitled to Rule 60(b)(6) relief; the court reversed and remanded. The majority reviewed the incorporated grounds for summary judgment, found legal error in the participation and knowledge rulings, and left further proceedings—including ultimate liability—to the district court. Judge Callahan dissented on both retroactivity and the scope of review, arguing the amendment was not retroactive and the appeal should not reach the underlying summary-judgment grounds.
